Administrative Orders Issued by NMED to WIPP (DOE and NWP) and LANL (DOE and LANS) Permittees :

    May 20, 2014 Administrative Order to WIPP

    • Issued pursuant to Sections 9-7A-1 to -15 of the Hazardous Waste Act

    • Specifics of the Order requiring the Permittees to:
      • By May 30, 2014 - submit a WIPP Nitrate Salt Bearing Waste Contain Isolation Plan, shall contain the following:
      • Proposal and schedule for expedited closure of Panel 6 
      • Proposal and schedule for expedited closure of Panel 7, Room 7 following the completion of the investigation
      • Provide daily updates on the implementation of the approved plan.


    May 19, 2014 Administrative Order to LANL

    • Issued pursuant to Section 74-4-13(A) of the Hazardous Waste Act

    • Specifics of the Order requiring the Permittees to:
      • By May 21, 2014 - submit to NMED a LANL Nitrate Salt Bearing Waste Container Isolation Plan


    May 12, 2014 Administrative Order to WIPP

    • Issued pursuant to Section 74-4-13(A) of the Hazardous Waste Act

    • includes amendments and clarifications to paragraphs 12, 14, & 15 of 2/27/14 Administrative Order

    • Specifics of the Order requiring the Permittees to:
      • By June 26, 2014 -  submit a draft Underground Compliance Plan to NMED, an Underground Derived Waste Storage Plan
      • Starting May 19, 2014  - augment current reporting required by 2/27/14 Administrative Order with bi-weekly reports due every other Friday beginning June 13, 2014. 
      • Begin monitoring for the VOC trichloroethylene (“TCE”) and follow action protocols outlined in the Order  for various levels detected.
      • Under no circumstances commence normal operating status without prior inspection and approval of the NMED

February 27, 2014 Administrative Order to WIPP

  • Issued pursuant to Section 74-4-13(A) of the Hazardous Waste Act,

  • Provides waste storage requirements at the surface of the facility due to the incident of February 14th at WIPP due to normal activities not resuming for a protracted period of time.

  • Requires the Permittees to not accept any further shipments of waste until corrective actions are taken in the underground repository.

  • The Order addresses compliance with above-ground WIPP Facility Permit requirements and related storage, inspections, monitoring, record keeping and reporting.  In light of DOE’s inability to operate, they are facing storage deadlines in their parking lot and Waste Handling Building.

  • Specifics of the Order:
    • Addresses above-ground storage issues and allows additional time for DOE to evaluate options for alternative storage locations;
    • Ensures the continued protection of human health and the environment by providing deadlines and requirements that NMED may enforce; 
    • Requires submission of certain data and reports on a weekly basis;
    • Requires the submission of a written proposal to NMED that outlines alternative storage options;
    • Requires NMED inspection and approval before DOE commences normal operations.
    • Container Venting Deadlines:
    • When waste shipping containers (TRUPACT containers) arrive at WIPP, the regular WIPP permit requires the air inside to be vented within 30 days.
    • The Order of 2/27 extends that venting deadline to 60 days. This 60-day venting deadline is also the Nuclear Regulatory Commission National Standard. 
    • When TRUPACT containers are vented, the vented air inside is filtered before being released.  During the venting process, continuous radiation testing is done all over the containers to ensure the safety of the workers and the surrounding atmosphere.  Thus, it is a controlled sequence that ensures contaminates are not released.
    • Over half of the containers at the WIPP site have already been vented.
