The Air Quality Bureau Enforcement Section assures the return to compliance with federal and state regulations and permit conditions by identifying corrective actions that a facility must take. The Enforcement Section calculates penalties for violations in accordance with the Air Quality Bureau’s Civil Penalty Policy.
- The section conducts meetings with sources to negotiate settlements, and oversees each facility’s return to compliance.
- Cases not resolved by the Enforcement Section are referred to the Office of General Counsel (OGC) for further handling, either by an Administrative Compliance Order or formal complaint in district court.

New Mexico Environment Department Announces Air Quality Compliance Assistance Policy and Assessment Program for Small Businesses
The New Mexico Environment Department (NMED) is pleased to announce that the Air Quality Bureau (AQB) has finalized a Small Business Compliance Assistance Policy and developed a compliance assessment program for New Mexico small businesses, except for those located in Bernalillo County or on tribal lands. The program offers free assistance to small businesses who want help in discovering air quality permit violations. The program allows for a small business to voluntarily disclose the violation(s) to the Air Quality Bureau and correct them within a specified timeframe with help from the Small Business Environmental Assistance Program. Small businesses in Bernalillo County should contact the City of Albuquerque Environmental Health Division. On tribal lands, small businesses should either contact the U.S. Environmental Protection Agency or the tribe directly.
