SMP I & II Waiver Request Form Instructions

Waivers may be requested for two Smoke Management Program Elements: Implementation of Emission Reduction Techniques (ERTs) (SMP II) and Evaluation of Smoke Dispersion (SMP I and II). Waivers are to be requested on a case-by-case basis, and are not granted until the requestor receives a signed copy from the AQB.

Waiver requests must be submitted two weeks prior to ignition, except for the Ventilation Category Waiver. The Ventilation Category Waiver must be submitted no later than 10:00 a.m. one business day prior to ignition. This later deadline accommodates weather forecasting. However, you may send in your ventilation waiver request at time of registration and obtain a waiver for the entire project. See SMP Appendix H for more information. Following are line-by-line instructions for filling out the Waiver Request Form.

Contact Information. Enter the burn project name, burn project ID, contact name, and phone number.  If this form is submitted along with the Registration Form, the ID number will be assigned by the AQB, otherwise, the ID number will have already been assigned, and the requestor must enter that number.

Explanation: This information allows AQB to contact the burner if necessary and track the particular burn project.

Type of Waiver. Check the appropriate box for the type of waiver(s) being requested. See SMP Appendix H for more information.

If the Implementation of ERTs box is selected, explain why none can be used. See Appendix D for more information on ERTs.

If the Time of Day box is selected, explain the circumstance that require nighttime burning. Include information on distance and direction to population(s). See Appendix E for information on smoke dispersion and Appendix H for more information on waivers.

If the Burning within 300 feet of dwellings/occupied places box is selected, explain the circumstance under which this is necessary. Include information on distance and direction to population(s). See Appendix E for more information on smoke dispersion and Appendix H for more information on waivers.

If the Burning under Fair to Poor ventilation categories is selected, explain the reasons why this is necessary. Include information on distance and direction to population(s). See Appendix E for more information on ventilation categories.

Explanation: This allows AQB to evaluate the request and either issue a waiver, issue a waiver with conditions or deny a waiver.
