A permit from NMED is required when manufacturing hemp-containing products for human ingestion, absorption, or smokable products.<\/p>\n\n\n\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>Do I need a permit to produce dried hemp products?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n\n\n\n<p>Yes, a hemp manufacturing permit from NMED required for drying and\/or processing (i.e. trimming) of hemp\/hemp flower into a finished product, or product that does not need further processing to be offered as a finished product.<\/p>\n\n\n\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>What is a hemp harvest certificate?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n\n\n\n<p>A document issued by the New Mexico Department of Agriculture to a person licensed to harvest hemp for distribution or sale certifying that a quantity of hemp meets the THC concentration required pursuant to 21.20.3 NMAC.<\/p>\n\n\n\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>What is a hemp transportation manifest?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n\n\n\n<p>A form used for identifying the quantity, composition, origin, routing and destination of hemp products during transportation.<\/p>\n\n\n\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>What is the maximum amount of THC allowed in a finished product?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n\n\n\n<p>The maximum THC concentration allowed in a hemp finished product is 0.30%.<\/p>\n\n\n\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>What are the zoning requirements for a hemp facility?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n\n\n\n<p>The zoning requirements for any business, including a hemp extraction or manufacturing facility or hemp warehouse, are determined by the local city\/municipality\/village\/etc. government.<\/p><\/div><\/div><\/div>\n\n\n<div class='nmenv_accordion'><ul class=\"wp-block-list\">\n<li class=\"has-large-font-size\"><strong>Section 2: Application and Permitting<\/strong><\/li>\n<\/ul>\n<div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>What is the general process for applying for a permit?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>An applicant completes the appropriate\u00a0<a href=\"https:\/\/www.env.nm.gov\/forms\/#\">application<\/a>\u00a0and submits it, along with the required fee, to NMED.\u00a0 The application is then reviewed and NMED then asks questions and\/or requests further information, if necessary.\u00a0 A pre-operational inspection is then scheduled and completed by NMED and if it is determined the facility meets the requirements in the hemp rules, approval is given to open and a permit to operate is issued by NMED. If the hemp facility does not meet the requirements to open, NMED will provide a list of needed corrections and will conduct another pre-opening inspection after receiving verification that all corrections have been made.\u00a0\u00a0<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>Do I need a permit to sell pre-packaged CBD or other hemp products?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>No, not at this time. IT is highly recommended that all pre-packaged product comes from a business is permitted\/licensed by the proper state authority to manufacture hemp finished products.\u00a0 This helps ensure safe and legal products are sold in NM.\u00a0 You can verify permitting\/licensing by requesting a copy of it and verifying it has been issued by the state agency listed\u00a0<a href=\"https:\/\/www.env.nm.gov\/cannabis-hemp\/approved-out-of-state-sources\/\">here<\/a>.<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>When do I need a hemp facility permit?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>When you are producing hemp extract, manufacturing hemp-containing products that are for human consumption (ingestion), absorption, or are smokable products.\u00a0 Also, if you are storing\/warehousing hemp extract, you must have a hemp warehouse permit to do so.<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>How much is the application fee?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>A non-refundable fee of $1000.00 is required with\u00a0<em>each<\/em>\u00a0hemp application submitted. The fee includes application, plan review, pre-operational and regular inspections, and permit fees.<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>How can I pay the hemp facility fee?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>The fee must be submitted with an application and can be paid via check or money order (made out the New Mexico Environment Department).<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>Where do I submit my application?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>When your application is complete,\u00a0<a href=\"mailto:cannabis.hemp.bureau@env.nm.gov\">email us<\/a>\u00a0for submission instructions.<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>How detailed does my application need to be?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>Applications submitted must be complete.\u00a0 Applicants must provide\u00a0<em>as much detail as possible\u00a0<\/em>for each question and\/or item. Incomplete applications will not be reviewed and will be returned to the applicant.\u00a0\u00a0<em><strong>The easiest way to explain how much detail is necessary is to say: \u201cwe should be able to use your application to produce your product for you, without additional input from you\u201d.<\/strong><\/em><\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>Why does the application look so much like a food manufacturer application?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>Many facility and production safety requirements are the same.<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>Can you come out and look at my facility I\u2019m thinking about renting before I submit my application?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>Limited resources currently prohibit this.\u00a0 The hemp program can answer specific questions regarding a facility.\u00a0 Questions should be\u00a0<a href=\"mailto:cannabis.hemp.bureau@env.nm.gov\">emailed<\/a>.<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>Do I need an operational plan for every item on my menu?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>Yes, but hemp products or types of production methods may be grouped together, if hazards and procedures required to produce them are essentially identical. An example of an acceptable grouping of products into a single operational plan is tinctures that are made using the same manufacturing process and ingredients and only vary in CBD content and\/or flavor. In this case, you would provide these products in a single list, followed by a single operational plan.\u00a0 Be sure to highlight the steps where differences exist (i.e. different amounts of CBD isolate added, or different flavors added).<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>I can\u2019t meet the requirements of the rules. Are there any applications for special circumstances?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>Not at this time.<\/p>\n<p><\/div><\/div><\/div>\n\n\n<div class='nmenv_accordion'><ul class=\"wp-block-list\">\n<li class=\"has-large-font-size\"><strong>Section 3: Hemp cultivation Questions<\/strong><\/li>\n<\/ul>\n<div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>If I am a grower licensed by the New Mexico Department of Agriculture, do I need a permit with NMED?\u00a0<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>If you perform extraction, process or manufacture hemp-derived material and\/or class=\"has-large-font-size\"><strong>Section 4: Purchasing Hemp or Hemp-derived Material<\/strong><\/li>\n<\/ul>\n<div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>Can I purchase ingredients, such as hemp, extract, distillate, or isolate from out of state sources?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>Yes, if the business you purchase from is NM-based and listed\u00a0<a href=\"https:\/\/www.env.nm.gov\/cannabis-hemp\/nm-approved-hemp-facilities\/\">here<\/a>, or is outside NM and\u00a0 licensed\/permitted by the state agency listed\u00a0<a href=\"https:\/\/www.env.nm.gov\/cannabis-hemp\/approved-out-of-state-sources\/\">here<\/a>.\u00a0<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>What do I need from a grower to accept hemp for extraction?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>NM-based hemp:\u00a0A\u00a0\u201cPASS\u201d harvest certificate from NMDA and a transportation manifest.<\/p>\n<p>Out-of-state hemp: A harvest certificate demonstrating the hemp was 0.3% THC concentration or less at harvest, a transportation manifest, and a copy of the permit\/license demonstrating the grower is properly permitted\/ licensed by the state agency identified&nbsp;<a href=\"https:\/\/www.env.nm.gov\/cannabis-hemp\/approved-out-of-state-sources\/\">here<\/a>.<\/p>\n<p>All records identified above must be filed as part of the hemp facility\u2019s record keeping procedures for a minimum of two years.<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>What do I need to accept hemp-derived material (i.e. extract, crude oil, distillate, isolate) produced by someone else?<\/strong><\/h2><\/div><div fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>Are there any tools available to help me with the labeling requirements?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>Yes, the\u00a0<a href=\"https:\/\/www.fda.gov\/regulatory-information\/search-fda-guidance-documents\/guidance-industry-food-labeling-guide\">FDA Food Labeling Guide<\/a>\u00a0is a great tool that will walk you through the labeling requirements outlined in 20.10.2.13A(1) of the hemp rules.<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>Can I put \u201cNo THC\u201d or \u201cTHC-Free\u201d on my product labels?\u00a0<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>No.\u00a0 The Hemp Rules prohibit statements representing or inferring a product is THC-free.<\/p>\n<p><\/div><\/div><\/div>\n\n\n<div class='nmenv_accordion'><ul class=\"wp-block-list\">\n<li class=\"has-large-font-size\"><strong>Section 6: Lab Questions<\/strong><\/li>\n<\/ul>\n<div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>What labs can I use to test my product?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>NMED maintains a\u00a0<a href=\"https:\/\/www.env.nm.gov\/cannabis-hemp\/analytical-laboratories\/\">list of labs<\/a>\u00a0approved to complete analytical testing required by the hemp rules.\u00a0 If other testing is required by customers, it does not have to be conducted by an approved lab.<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>I have a lab that I want to use, h<\/strong><strong>ow does an analytical laboratory become NMED approved for hemp finished product testing in NM?<\/strong><\/h2><\/div><div class='nmenv_accordion_item_body'>\n<p>There are currently two ways to be approved for hemp finished product testing for NM produced products.\u00a0\u00a0<\/p>\n<ol class=\"wp-block-list\">\n<li>Approved by the New Mexico Department of Health (NMDOH) Medical Cannabis Program.<\/li>\n<li>ISO accredited for hemp and\/or cannabis within the scope of the analytical testing requirements in the Hemp Rules.<\/li>\n<\/ol>\n<p>Approved analytical laboratories are listed&nbsp;<a href=\"https:\/\/www.env.nm.gov\/cannabis-hemp\/analytical-laboratories\/\">here<\/a>.&nbsp; To request approval from NMED, submit a request, along with your NMDOH or ISO accreditation information&nbsp;<a href=\"mailto:cannabis.hemp.bureau@env.nm.gov\">here<\/a>.<\/p>\n<\/div><\/div><div class='nmenv_accordion_item level_0'><div class='nmenv_accordion_item_title'><i class='fas fa-chevron-right' aria-hidden='true'><\/i><h2 class=\"wp-block-heading\"><strong>What are the testing requirements for hemp products?\u00a0<\/strong><\/h2><\/div><div
