Environmental Improvement Board Applicable Legislation<\/h2>\n\n\n\n

EIB Establishing Authority<\/span><\/h2>\n\n\n\n

The EIB is established in the Environmental Improvement Act<\/a>.  The Board consists of seven Governor appointed, and Senate consented, members.  No more than four of the members are from the same political party, and a majority of the members must represent the interests of the public.  A quorum of the Board is four members.  See NMSA 1978, \u00a774-1-4<\/a>.<\/span><\/p>\n\n\n\n

Pursuant to NMSA, <\/a>\u00a7 74-1-8<\/a>, the Board is responsible for environmental management and consumer protection. The EIB is responsible for the promulgation of rules and standards in:<\/span><\/p>\n\n\n\n

(1) food protection<\/a>;<\/span><\/p>\n\n\n\n

(2) water supply, including a capacity development<\/a> program to assist water systems in acquiring and maintaining technical, managerial and financial capacity in accordance with \u00a71420<\/a> of the federal Safe Drinking Water Act<\/a> (Title XIV of the Public Health Service Act) and rules authorizing imposition of administrative penalties for enforcement;<\/span><\/p>\n\n\n\n

(3) liquid waste<\/a>, including exclusive authority to establish on-site liquid waste system fees and to implement and administer an inspection and permitting program<\/a> for on-site liquid waste systems;<\/span><\/p>\n\n\n\n

(4) air quality management<\/a> as provided in the state Air Quality Control Act<\/a> (NMSA 1978, \u00a7\u00a7 74-2-1 to 74-2-17);<\/span><\/p>\n\n\n\n

(5) radiation control<\/a> as provided in the state Radiation Protection Act<\/a> (NMSA 1978, \u00a7\u00a7 74-3-1 to 74-3-16);<\/span><\/p>\n\n\n\n

(6) noise control;<\/span><\/p>\n\n\n\n

(7) nuisance abatement;<\/span><\/p>\n\n\n\n

(8) vector control;<\/span><\/p>\n\n\n\n

(9) occupational health and safety <\/a>as provided in the Occupational Health & Safety Act<\/a> (NMSA 1978, \u00a7\u00a7 50-9-1 to 50-9-25);<\/span><\/p>\n\n\n\n

(10) sanitation of public swimming pools and public baths<\/a>;<\/span><\/p>\n\n\n\n

(11) plumbing, drainage, ventilation and sanitation of public buildings in the interest of public health;<\/span><\/p>\n\n\n\n

(12) medical radiation, health and safety certification and standards for radiologic technologists<\/a> as provided in the Medical Radiation Health & Safety Act<\/a> (NMSA 1978, \u00a7\u00a7 61-14E-1 to 61-14E-12);<\/span><\/p>\n\n\n\n

(13) hazardous wastes<\/a> and petroleum storage tank<\/a>s as provided in the Hazardous Waste Act<\/a> (NMSA 1978, \u00a7\u00a7 74-4-1 to 74-4-14); and <\/span><\/p>\n\n\n\n

(14) solid waste<\/a> as provided in the Solid Waste Act<\/a> (NMSA 1978, \u00a7\u00a7 74-9-1 to 74-9-43).<\/span><\/p>\n\n\n\n
