The fees have not been updated since 2001. Since 2001, inflation has increased substantially and permitting responsibilities have expanded, rendering the current fee schedule inadequate to support permitting program costs. Amendments to the Water Quality Act approved in 2025 authorized NMED to recover the full cost of permitting programs, including administrative, legal, compliance, and enforcement costs. The proposed fee revisions aim to stabilize program funding, fully staff permitting and inspection programs, and improve oversight and compliance outcomes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NMED filed a petition with the Water Quality Control Commission (WQCC) on October 1, 2026 proposing a rulemaking effort to revise the permit fee schedule and associated language described in 20.6.2.3114 NMAC.
