The State of New Mexico\u2019s authority to regulate the storage, treatment, and disposal of hazardous waste at the Triassic Park Hazardous Waste Facility (TP<\/strong>) for the protection of human health and the environment is governed under the New Mexico Hazardous Waste Act (HWA<\/strong>) and the Resource Conservation and Recovery Act (RCRA<\/strong>). Under RCRA, State programs are authorized to operate in lieu of the Environmental Protection Agency (EPA<\/strong>). New Mexico is authorized by EPA to issue and enforce RCRA hazardous waste facility permits under 50 Fed Reg 1515 (January 11, 1985). New Mexico implements this authority under the HWA, NMSA 1978, \u00a774-4-1 et seq (Repl. Pamp. 2000).<\/p>\n\n\n\n

On March 18, 2002, the New Mexico Environment Department (NMED<\/strong>) first issued a Hazardous Waste Facility Permit to Gandy Marley, Inc. (GMI<\/strong>), hereafter referred to as the \u201cPermittee,\u201d for the storage, treatment, and disposal of hazardous waste at their facility in southeastern New Mexico on approximately 480 acres of land in Chaves County. The Permit addresses requirements for the storage of hazardous wastes at three units; a drum-handling unit, a roll-off container unit, and liquid waste storage tanks, the treat of hazardous waste at two units; treatment tanks and surface impoundments, and the disposal of hazardous waste in a double-lined hazardous waste landfill with a capacity of 553,200 cubic yards and covering approximately 35 acres. The TP Permit is the only permit for a commercial hazardous waste disposal<\/u> facility in New Mexico. The Permit specifies that it shall be effective for a term of ten years. The hazardous waste portion of the Triassic Park Waste Disposal Facility has not yet been constructed.<\/p>\n\n\n\n

January 2017<\/strong> \u2013 Public comments received<\/a> during the NMED public comment period of June 15, 2016 through January 20, 2017 with extensions.<\/p>\n\n\n\n

November 17, 2016 \u2013 Public Comment Period Second Extension <\/strong>\u2013 NMED issued a public notice extending the public comment and request for public hearing on the draft Permit. The public comment period began on June 15, 2016, and was extended initially to November 18, 2016. The public comment period was extended to 5:00 PM MST, January 20, 2016<\/strong>. April 30, 2012<\/strong> \u2013 The Permittee submitted a revised permit application<\/a> to address deficiencies in the NMED Notice of Administrative Incompleteness letter.<\/p>\n\n\n\n

March 14, 2012<\/strong> \u2013 NMED issued a letter<\/a> to the Permittee indicating that the permit application was determined to be administratively incomplete.<\/p>\n\n\n\n

November 29, 2011<\/strong> \u2013 NMED notified the public via a mail-out and publication in major local newspapers that the October 17, 2011 hazardous waste permit renewal application (see below) was submitted to the NMED and that it is available for public review. See the public notice by clicking here<\/a>. The notice explains that no action or decision is proposed by NMED at this time regarding the permit renewal application.<\/p>\n\n\n\n

October 17, 2011<\/strong> \u2013 The Permittee submitted to the New Mexico Environment Department (NMED) a hazardous waste permit renewal application for the Triassic Park Waste Disposal Facility. The renewal application proposes a significantly scaled back facility, retaining the ability to dispose of hazardous waste in the landfill.
