Under RCRA, State programs are authorized to operate in lieu of the Environmental Protection Agency (<strong>EPA<\/strong>). New Mexico is authorized by EPA to issue and enforce RCRA hazardous waste facility permits under 50 Fed Reg 1515 (January 11, 1985). New Mexico implements this authority under the HWA, NMSA 1978, \u00a774-4-1 et seq (Repl. Pamp. 2000).<\/p>\n\n\n\n<p>On March 18, 2002, the New Mexico Environment Department (<strong>NMED<\/strong>) first issued a Hazardous Waste Facility Permit to Gandy Marley, Inc. (<strong>GMI<\/strong>), hereafter referred to as the \u201cPermittee,\u201d for the storage, treatment, and disposal of hazardous waste at their facility in southeastern New Mexico on approximately 480 acres of land in Chaves County. The Permit addresses requirements for the storage of hazardous wastes at three units; a drum-handling unit, a roll-off container unit, and liquid waste storage tanks, the treat of hazardous waste at two units; treatment tanks and surface impoundments, and the disposal of hazardous waste in a double-lined hazardous waste landfill with a capacity of 553,200 cubic yards and covering approximately 35 acres. The TP Permit is the only permit for a commercial hazardous waste <u>disposal<\/u> facility in New Mexico. The Permit specifies that it shall be effective for a term of ten years. The public comment period began on June 15, 2016.\n<br><a href=\"https:\/\/hwbdocuments.env.nm.gov\/Triassic%20Park%20Disposal%20Facility\/2016-06-15%20Public%20Notice%20-%20English.pdf\">Public Notice \u2013 English<\/a><\/p>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\" \/>\n\n\n\n<p><strong>July 5, 2013<\/strong> \u2013 The Permittee submitted a <a href=\"https:\/\/cloud.env.nm.gov\/waste\/?c=219&amp;k=59204a2d40\">revised permit application<\/a> to address deficiencies in the NMED February 5, 2013 Notice Disapproval Letter.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\" \/>\n\n\n\n<p><strong>July 5, 2013<\/strong> \u2013 NMED <a href=\"\/wp-content\/uploads\/sites\/12\/2019\/10\/Apprvl_Ext_Rqst_NOD_Resp_TPDF_July2013.pdf\">approved the request for an extension<\/a> to respond to the NMED Disapproval Letter<\/p>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\" \/>\n\n\n\n<p><strong>July 2, 2013<\/strong> \u2013 The Permittee <a href=\"\/wp-content\/uploads\/sites\/12\/2019\/10\/TPDF_Ext_Req_Letter_07-02-13.pdf\">requested an extension<\/a> to respond to the NMED Disapproval Letter<\/p>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\" \/>\n\n\n\n<p><strong>February 5, 2013<\/strong> \u2013 NMED issued a <a href=\"\/wp-content\/uploads\/sites\/12\/2019\/10\/TP_2-5-2013_Disapproval_Permit_App.pdf\">Disapproval Letter<\/a> to the Permittee on the Part A and B Renewal Application.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\" \/>\n\n\n\n<p><strong>May 17, 2012<\/strong> \u2013 NMED determined the application to be <a href=\"\/wp-content\/uploads\/sites\/12\/2019\/10\/TPDF-12-001_5-17-2012_Admin_Complete_-_Fee_Assessment.pdf\">administratively complete<\/a>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\" \/>\n\n\n\n<p><strong>April 30, 2012<\/strong> \u2013 The Permittee submitted a <a href=\"https:\/\/cloud.env.nm.gov\/waste\/?c=218&amp;k=4e9b0e9e70\">revised permit application<\/a> to address deficiencies in the NMED Notice of Administrative Incompleteness letter.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\" \/>\n\n\n\n<p><strong>March 14, 2012<\/strong> \u2013 NMED issued a <a href=\"\/wp-content\/uploads\/sites\/12\/2019\/10\/TP-3-14-2012_Admin_Incomplete_Determination.pdf\">letter<\/a> to the Permittee indicating that the permit application was determined to be administratively incomplete.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\" \/>\n\n\n\n<p><strong>November 29, 2011<\/strong> \u2013 NMED notified the public via a mail-out and publication in major local newspapers that the October 17, 2011 hazardous waste permit renewal application (see below) was submitted to the NMED and that it is available for public review. See the public notice by <a href=\"\/wp-content\/uploads\/sites\/12\/2019\/10\/TraissicPark-PublicNoticeofReceiptofAppication11-29-2011.pdf\">clicking here<\/a>. The notice explains that no action or decision is proposed by NMED at this time regarding the permit renewal application.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\" \/>\n\n\n\n<p><strong>October 17, 2011<\/strong> \u2013 The Permittee submitted to the New Mexico Environment Department (NMED) a hazardous waste permit renewal application for the Triassic Park Waste Disposal Facility. The renewal application proposes a significantly scaled back facility, retaining the ability to dispose of hazardous waste in the landfill. The application does not propose the ability to store or treat hazardous wastes.
