The subject of the various modifications included (1) addition of packaging-specific drum age criteria (<strong>DAC<\/strong>) for newly approved waste containers; (2) removal of underground booster fans; (3) elimination of headspace gas sampling and analysis requirements for LANL sealed sources; (4) removal of formaldehyde as a required analytical parameter for LANL; (5) addition of new hazardous waste numbers; and (6) removal of the polychlorinated biphenyl (<strong>PCB<\/strong>) prohibition in the permit. After considering all public comment, NMED approved all modifications except the additional DAC (Item 1) and LANL sealed sources (Item 3). NMED found the PMR to be technically deficient, and provided NOD comments listing the requested information necessary for NMED to consider preparation of a draft Permit.&nbsp; The Permit was not modified as a result of this administrative action.<br><\/span><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\"><a href=\"\/wp-content\/uploads\/sites\/12\/2019\/10\/rhnod0303.pdf\">Cover letter with NMED NOD Comments<\/a><\/span><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\"><strong>January 30, 2003<\/strong> \u2013 NMED issued a revised Permit in response to a Final Order from NMED Secretary John D\u2019Antonio regarding the <a href=\"https:\/\/hwbdocuments.env.nm.gov\/Waste%20Isolation%20Pilot%20Plant\/001208.pdf\">Drum Age Criteria (<strong>DAC<\/strong>) permit modification<\/a>. The Final Order adopted the Hearing Officer\u2019s Report and the Hazardous Waste Bureau\u2019s Proposed Findings of Fact and Conclusions of Law. With additional specific changes identified in the Final Order, the Permit generally reflects the Proposed Final Permit subject to public hearing in August 2002.<br><\/span><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\"><a href=\"\/wp-content\/uploads\/sites\/12\/2019\/10\/NMED_DAC_Findings-Conclusions.pdf\">NMED Hazardous Waste Bureau\u2019s Proposed Findings of Fact and Conclusions of Law<\/a> \u2013 issued October 9, 2002<br><\/span><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\"><a href=\"\/wp-content\/uploads\/sites\/12\/2019\/10\/HO_Report_DAC_Mod.pdf\">NMED Hearing Officer\u2019s Report<\/a> \u2013 issued December 19, 2002<br><\/span><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\"><a href=\"\/wp-content\/uploads\/sites\/12\/2019\/10\/Final_Order_DAC_Mod.pdf\">NMED Secretary\u2019s Final Order<\/a> \u2013 issued December 31, 2002<\/span><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\"><strong>January 14, 2003<\/strong> \u2013 NMED received notification today from the Department of Energy that it was formally withdrawing the Class 3 permit modification entitled <a href=\"https:\/\/hwbdocuments.env.nm.gov\/Waste%20Isolation%20Pilot%20Plant\/000735.pdf\">Centralized Waste Confirmation<\/a>. The letter stated:<\/span><\/p>\n\n\n\n<p><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\">\u201cThe United States Department of Energy (DOE), Carlsbad Field Office (CBFO) is requesting that the Class 3 permit modification entitled Centralized Waste Confirmation submitted to the New Mexico Environment Department (NMED) on June 6, 2001 be rescinded and that further review of this permit modification cease.<\/span><\/p>\n\n\n\n<p><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\"> \u201cThe DOE is currently performing further cost\/benefit analyses of this program to verify that this is the most cost effective and efficient mechanism by which to aid small quantity generators in the characterization and confirmation of their waste.<\/span><\/p>\n\n\n\n<p><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\">Although not explicitly referenced, this withdrawal appears to be related to an audit report issued December 18, 2002 by the DOE Office of Inspector General entitled \u201c<a href=\"\/wp-content\/uploads\/sites\/12\/2017\/03\/ig-0577.pdf\">Planned Characterization Capability At The Waste Isolation Pilot Plant<\/a>\u201d (Report IG-0577), available <a href=\"https:\/\/www.energy.gov\/sites\/prod\/files\/igprod\/documents\/CalendarYear2002\/ig-0577.pdf\">here<\/a> (external link, 1089 KB PDF file).<\/span><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><span style=\"font-size: 10pt;\"><strong><span style=\"font-family: verdana,geneva,sans-serif;\">2002<\/span><\/strong><\/span><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\"><strong>December 26, 2002<\/strong> \u2013 NMED issued a Final Determination on a single Class 1* modification request to change the closure schedule for Panel 1. Permit Attachment I (Closure Plan) was modified as a result of this administrative action. <br><\/span><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\"><a href=\"\/wp-content\/uploads\/sites\/12\/2019\/10\/finaldet1202.pdf\">Final Determination letter<\/a><\/span><\/p>\n\n\n\n<p><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\">&nbsp;<\/span><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\"><strong>November 25, 2002<\/strong> \u2013 NMED issued a Final Determination on Class 2 modification requests to the WIPP Permit submitted by the Permittees on June 28, 2002. The subject of the permit modification included: (1) characterizing repackaged homogeneous solids as retrievably stored waste; (2) the use of radiography for newly generated waste; (3) addition of the HalfPACT shipping container; (4) addition of a new hazardous waste number U134 for hydrofluoric acid; (5) new record keeping and auditing requirements for classified information; and (6) addition of new waste containers and direct loading of other existing waste containers. After considering all public comment, NMED approved all items with and without changes based upon comments. NMED\u2019s Proposed Final permit, dated August 26, 2002, would still allow specific DAC to apply to specific waste packaging configurations, but it includes further changes to the May 13, 2002 draft permit based upon prior public comment. With the exception of those modifications identified in the letter as being either withdrawn, rejected, or accepted with changes, all other modifications identified in the Notices of Class 1 Modification listed in the letter as being administratively complete have been put into effect.<br><\/span><a href=\"https:\/\/hwbdocuments.env.nm.gov\/Waste%20Isolation%20Pilot%20Plant\/010845.pdf\"><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\">Cover letter with NMED Comments sent to Permittees<\/span><\/a><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\"><strong>August 30, 2001<\/strong> \u2013 NMED issued letters related to two Class 2 modifications submitted by the Permittees on May 2, 2001.<\/span><\/p>\n\n\n\n<p><span style=\"font-family: verdana,geneva,sans-serif; font-size: 10pt;\">In the first letter, NMED denied the Ten-Drum Overpack (<strong>TDOP<\/strong>) Volume request to increase the storage capacity in the Waste Handling Building by approximately 12% and to consolidate the descriptions of containers into one attachment to the permit. The legislation signed by the President on July 13, 2000, renders the permit conditions requiring financial assurance unenforceable. \u201cCongress has enacted controlling legislation which states that a financial guarantee cannot be required of a federal contractor at WIPP. Therefore, earlier today I advised both the United States Department of Energy and Westinghouse that the permit condition requiring financial assurance in the WIPP permit is withdrawn and will not be enforced.
