{"id":8,"date":"2021-06-25T20:33:12","date_gmt":"2021-06-25T20:33:12","guid":{"rendered":"https:\/\/www.env.nm.gov\/occupational_health_safety\/?page_id=8"},"modified":"2026-04-02T15:32:53","modified_gmt":"2026-04-02T21:32:53","slug":"nm-announcements","status":"publish","type":"page","link":"https:\/\/www.env.nm.gov\/occupational_health_safety\/nm-announcements\/","title":{"rendered":"NM OSHA Announcements"},"content":{"rendered":"\n<p><strong>Civil Penalty Adjustments for 2026<\/strong><\/p>\n\n\n\n<p>April 2, 2026<\/p>\n\n\n\n<p>In November 2015, Congress enacted the Federal Civil Penalties Adjustment Act of 2015 (\u201cFCPAA\u201d) requiring Federal agencies, including OSHA, to adjust their penalties to account for inflation. Pub. L. I 14- 74 (Nov. 2, 2015) 129 Stat. 599. Such inflation adjustments had not been made to OSHA penalties since 1990.<\/p>\n\n\n\n<p>On July 1, 2016, Federal OSHA published a <a href=\"https:\/\/www.env.nm.gov\/wp-content\/uploads\/sites\/18\/2018\/12\/FED20160701.pdf\">Final Rule<\/a> to increase federal penalties as prescribed by Congress; Federal OSHA concurrently notified all state plans of their obligation to make an \u201cat least as effective\u201d change to state maximum penalties. Establishments located in states under Federal OSHA jurisdiction were required to comply with the new requirements on August 1, 2016. In October 2016, the New Mexico Environment Department notified Federal OSHA of the State\u2019s intent to seek legislation during the 2017 session to increase statutory maximum penalties in accordance with Federal law.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.env.nm.gov\/wp-content\/uploads\/sites\/18\/2018\/12\/SB0229-Final.pdf\">Senate Bill 229 <\/a>(\u201cSB 229\u201d), signed into law on April 6, 2017, amended the Occupational Health and Safety Act, 50-9 NMSA 1978, to adjust maximum and minimum penalties in conformance with Federal law. The legislation conforms to the requirements of the Federal Occupational Safety and Health Act, the FCPAA, and Federal OSHA rules for approval of State occupational health and safety plans.<\/p>\n\n\n\n<p>The penalty levels contained in the <a href=\"https:\/\/service.web.env.nm.gov\/urls\/njnbNNqt\">Maximum and Minimum Penalties<\/a> reflect increases to maximum and minimum penalties to conform with SB 229.
