{"id":12,"date":"2021-06-25T18:34:05","date_gmt":"2021-06-25T18:34:05","guid":{"rendered":"https:\/\/www.env.nm.gov\/liquid_waste\/liquid-waste-permitting-process\/"},"modified":"2024-03-21T18:37:58","modified_gmt":"2024-03-21T18:37:58","slug":"liquid-waste-permitting-process","status":"publish","type":"page","link":"https:\/\/www.env.nm.gov\/septic\/liquid-waste-permitting-process\/","title":{"rendered":"Liquid Waste Permitting Process"},"content":{"rendered":"\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">Application<\/h2>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Print and fill out an <a href=\"\/septic\/forms-3\/\">Application for Liquid Waste Permit<\/a>\n<ol class=\"wp-block-list\">\n<li>Must include signatures granting authorization by either owner or owner\u2019s authorized representative,\n<ul class=\"wp-block-list\">\n<li>Licensed contractors with one of the following licenses (MM-1, MM-98, MS-1, MS-3) are qualified to install septic systems.<\/li>\n\n\n\n<li>Homeowners may install simple conventional systems after passing a written test.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Application must be complete, including approved materials, proper sizing, soil characteristics, geological and hydrological conditions, site conditions and:<\/li>\n<\/ol>\n<\/li>\n\n\n\n<li>Required Supporting Documentation:\n<ol class=\"wp-block-list\">\n<li>Proof of Ownership \u2013 Tax Bill and\/or Recorded Warranty Deed, Real Estate Contract or other  documentation that may reasonably establish ownership, Section 20.7.3.401E NMAC,<\/li>\n\n\n\n<li>Site Diagram \u2013 Showing structures, wells, boundaries, liquid waste systems, and other appropriate setbacks as listed in Table 301.1,<\/li>\n\n\n\n<li>Floorplan  \u2013 For residential structures show number of bedrooms; for commercial properties show fixtures or other information related to sizing,<\/li>\n\n\n\n<li>Plat or Survey \u2013 May be provided to show boundaries, acreage or other relevant features of the lot,<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Submit Complete Application Package to the local NMED Field Office for review<\/strong><\/h2>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n\n\n<ol class=\"wp-block-list\">\n<li>NMED will notify applicant of actions taken on the permit application.<\/li>\n\n\n\n<li>Actions may included granting the permit, granting with conditions, or denial.<\/li>\n\n\n\n<li>Conventional Systems may take up to five (5) business days for completeness check and ten business (10) days to return a decision.<\/li>\n\n\n\n<li>Advanced Treatment Systems may take up to ten (10) business days for completeness check and twenty business (20) days to return a decision.<\/li>\n\n\n\n<li>The Variance Process will take a minimum of twenty (20) days to allow for the public notification process and review.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Pay for Permit<\/strong><\/h2>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Pay for permit only after you are contacted by NMED to inform you that your permit was approved or approved with conditions. Do not submit payment before notice of approval.<\/li>\n\n\n\n<li>After the payment is received, a Permit to Construct (PtC) will be issued.<\/li>\n\n\n\n<li>The PtC is valid for one year, but that timeline my be extended (in most cases, up to one year) by the Department in writing. <\/li>\n\n\n\n<li>After the permit to construct has been issued, you may install the system in accordance with the permit and as long as the permit is valid.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Request Inspection<\/strong><\/h2>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Request inspection by NMED<strong> a minimum<\/strong> of <strong> <\/strong>48 hours (2 business days) in advance. Do not cover the system before inspection.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>After the Final Inspection:<\/strong><\/h2>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n\n\n<ul class=\"wp-block-list\">\n<li>After the final inspection, if your system is approved, you will receive a copy of the Permit to Operate (PtO).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Notes:<\/strong><\/h2>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity\"\/>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Incomplete Applications may delay the permitting process<\/li>\n\n\n\n<li>NMED may conduct a pre-inspection of the site by request or if required.<\/li>\n\n\n\n<li>Additional information may be required to reasonably establish lot size, boundaries and date of record, easements and other relevant details as per Section 20.7.3.401E NMAC<\/li>\n\n\n\n<li><strong>Advanced Treatment Systems (ATS)<\/strong> may require additional documention, including a signed Maintenance Contract, signed Sampling Contract, Statement of site conditions, Sampling Port Details and the reason an ATS is required.<\/li>\n\n\n\n<li>The <strong>Variance<\/strong> <strong>process<\/strong> has special requirements further described in the Variance section of the website.<\/li>\n\n\n\n<li><strong>Appeal Process<\/strong> \u2013 If your permit application was denied by NMED, or granted with conditions that you object to, you may appeal this decision.  <a href=\"http:\/\/www.srca.nm.gov\/parts\/title20\/20.007.0003.html\">Liquid Waste Disposal Regulation 20.7.3.406 (NMAC)<\/a> provides that any person who is dissatisfied with an action taken by NMED on a permit application or variance petition may appeal to the NMED Secretary.
