Environmental Justice

The State of New Mexico is committed to affording all of its residents, including communities of color and low-income communities, fair treatment and meaningful involvement in the development, implementation, and enforcement of environmental laws, regulations, and policies regardless of race, color, ethnicity, religion, income or educational level.

The State of New Mexico is further committed to promoting the protection of human health and the environment, empowerment via public involvement in the development, implementation, and enforcement of environmental laws, regulations, and policies, and the dissemination of information related to the environment to inform and educate, especially in people of color and low-income communities. (Environmental Justice Executive Order 2005-56)

The Solid Waste Bureau is committed to upholding environmental justice practices in its activities. New Mexico Solid Waste Rules address environmental justice issues during the permitting or modification of landfills and transformation facilities.  The permit applicant is required to determine if the proposed site is in a vulnerable area, as defined in the NM Solid Waste Rules.  If the site is in a vulnerable area, the applicant must provide a Community Impact Assessment addressing issues raised by the community.

Public Involvement Plans

The Solid Waste Bureau produces Public Involvement Plans (PIPs) for current permitting actions.  A PIP includes an evaluation of the community in the vicinity of the solid waste facility, considers the need for language translation or interpretation services, and describes the public notice actions to be taken for the mandatory public hearing on the permit application.
