In accordance with 40 CFR 131.14 and 20.6.4.10 NMAC, any person may petition the commission to adopt a temporary standard. A temporary standard may be granted if one of the conditions in 40 CFR 131.10(g) has been demonstrated to be preventing the attainment of the use or criteria. Additionally, a temporary standard demonstration must provide the highest attainable condition (or interim condition). Based on conditions demonstrating treatment for nutrients to the state\u2019s numeric thresholds would cause the City of Raton Substantial and Widespread Economic and Social Impacts (SWESI), the Department petitioned the Water Quality Control Commission (WQCC), for a twenty-year discharger-specific nutrient temporary standard for the City of Raton\u2019s Wastewater Treatment Plant to Doggett Creek.<\/p>\n\n\n\n
