UAAs Based on SWQB's Hydrology Protocol

New Mexico Waters Subject to 20.6.4.97 NMAC

Use Attainability Analyses (UAAs) based on the agency’s Hydrology Protocol (HP) have demonstrated to the satisfaction of the department that federal Clean Water Act (CWA) Section 101(a)(2) uses (i.e., ‘fishable, swimmable’ uses) are not feasible. Upon receiving technical approval from the United States Environmental Protection Agency (EPA), these waters are subject to the New Mexico Water Quality Standards, 20.6.4 NMAC and the designated uses of limited aquatic life, secondary contact, livestock watering and wildlife habitat apply. The use-specific criteria in 20.6.4.900 are also applicable to the designated uses.

The HP UAAs listed below have EPA technical approval and associated waters are subject to 20.6.4.97 NMAC.
