If you are planning work in an arroyo, river, stream, or wetland, a United States Army Corps of Engineers (USACE) permit (Section 10 of the Rivers and Harbors Act and/or Section 404 of the Clean Water Act) may be required.

CLEAN WATER ACT §401: WATER QUALITY CERTIFICATION

Section 401 water quality certification for nationwide permits (NWPs) in New Mexico has been variously issued, waived, denied, or conditioned by the various certifying agencies. A list of certifying agencies and specific requirements for Tribal Governments, the United States Environmental Protection Agency (USEPA), or the State of New Mexico can be obtained from the USACE website.  You must obtain any required project-specific water quality certification from the appropriate water quality certification authority for your project area prior to construction under the specified NWPs.  Individual permits will require a project-specific CWA § 401 water quality certification from the appropriate certifying agency.

The New Mexico Environment Department's Surface Water Quality Bureau (NMED-SWQB) issued conditional certification to use NWPs for projects in ephemeral stream channels. NMED-SWQB denied certification for projects in intermittent or perennial streams.  For projects in intermittent or perennial streams, and wetlands you must obtain a project-specific water quality certification.  Joint USACE/NMED-SWQB applications can be obtained from the USACE Albuquerque District Regulatory Program website.   For a copy of the conditional certification for ephemeral stream channels or for more information:
