Proposed Final Rule Overview

The New Mexico Environment Department is seeking public participation and comments on the proposed amendments to 20.10.2 NMAC

The Cannabis and Hemp Bureau has, developed a draft of the proposed amendments, to New Mexico Administrative Code (NMAC) 20.10.2.  The objective of the Hemp Post-harvest Processing rule is to protect public health by establishing standards and provisions for the safe operation of hemp facilities to ensure that consumers are not exposed to adverse environmental health conditions.  

Members of the public are encouraged to review the proposed amendments, attend public meetings, and provide comments.

Rule Amendment Summary

  • Rule amendment applies to extraction, manufacturing, warehouse, and retail facilities operating in NM.
  • Makes Emergency Rule, which was effective August 1, 2025, permanent.
  • Limits Total THC in hemp finished products.
  • Implements pesticide use and testing requirements.
  • New warning statements on labels.
  • Provides allowances for warning statements on labels.
  • Allows the use of QR codes on labels.
  • Requires retail producers, such as restaurants and bakeries, meet same requirements of wholesale producers.
  • Institutes food handler card requirement.
