Food/Cannabis Edibles Rule (effective 10/1/2026)

Rule Amendment Summary

  • Rule amendment applies to Cannabis Edibles Manufacturers permitted by the NMED Cannabis and Hemp Bureau.
  • Rule is effective October 1, 2026.
  • Requires a plan review application fee for each facility application as follows:
  • $400.00 – 0 – 1000 square feet of processing, storage and ware washing areas.
  • $900.00 – 1001 – 2000 square feet of processing, storage and ware washing areas.
  • $1,400.00 – 2001+ square feet of processing, storage and ware washing areas.
  • Increases re-inspection fee from $100.00 to $500.00
  • Institutes a $400.00 variance application fee.
  • Increases permit renewal late fee from $25.00 to $175.00.
  • Manufactured Food and Cannabis Edible Facilities must now comply with adopted portions of 21 CFR 117.  See page 249 here.  No major changes to facilities or operations will be needed.  This change was made to align NM-based food manufacturers with FDA requirements and to further standardize the requirements b/t hemp and cannabis edible manufacturing facilities within the state.  Those operating dual use facilities (hemp and cannabis) or separate facilities for each, now have almost identical requirements to meet.
