Businesses and Procurement Officials

PFAS Beaker iconPFAS are human-made chemicals that make products resistant to heat, water, stains, and oil. Following passage of the PFAS Protection Act in 2025, certain product categories cannot be sold in New Mexico if they are made with intentionally added PFAS, beginning in 2027. Additional product phase-outs will occur in 2028 and 2032. New Mexico will also require manufacturers to identify items made with intentionally added PFAS by placing a label on the product, its packaging, websites, or product manuals and other literature.

The PFAS label is an easy way for purchasers and business owners to help protect New Mexicans by avoiding products made with “forever chemicals,” some of which have long-lasting effects on our health and the environment. Beginning in 2027, products that will carry the PFAS label include cleaning products, furniture, clothing, cars, heating and cooling equipment, and some personal care products. The sale of certain cookware, food packaging, dental floss, and juvenile products made with PFAS will be phased out in New Mexico starting in 2027. Additional product phase-outs will occur in 2028 and 2032. There are product alternatives made without PFAS that are available to meet your organization’s price, functionality, and quality requirements.
