Emergency Rule Overview
On August 1, 2025 the New Mexico Environment Department (NMED) promulgated an emergency amendment to 20.10.2 NMAC Hemp Extraction, Production, Transportation, Warehousing, and Testing to address current and emerging concerns with the production and use of synthesized cannabinoids in hemp finished products. The emergency amendment is applicable for hemp facilities operating in New Mexico.
Emergency Rule Amendment Summary
- Emergency rule amendment applies to extraction & manufacturing facilities operating in NM
- Define semi-synthetic and synthetic cannabinoid
- Ban the production of all semi-synthetic and synthetic cannabinoids
- Ban the use of most semi-synthetic and synthetic cannabinoids in hemp products
- Allows the use of specific non-intoxicating semi-synthetic and synthetic cannabinoids in hemp products
- Hemp facilities must demonstrate hemp ingredients received are hemp-derived
- Hemp facilities have until August 15 to fully comply
