The State of New Mexico’s authority to regulate the storage, treatment, and disposal of hazardous waste at the Triassic Park Hazardous Waste Facility (TP) for the protection of human health and the environment is governed under the New Mexico Hazardous Waste Act (HWA) and the Resource Conservation and Recovery Act (RCRA). Under RCRA, State programs are authorized to operate in lieu of the Environmental Protection Agency (EPA). New Mexico is authorized by EPA to issue and enforce RCRA hazardous waste facility permits under 50 Fed Reg 1515 (January 11, 1985). New Mexico implements this authority under the HWA, NMSA 1978, §74-4-1 et seq (Repl. Pamp. 2000).

On March 18, 2002, the New Mexico Environment Department (NMED) first issued a Hazardous Waste Facility Permit to Gandy Marley, Inc. (GMI), hereafter referred to as the “Permittee,” for the storage, treatment, and disposal of hazardous waste at their facility in southeastern New Mexico on approximately 480 acres of land in Chaves County. The Permit addresses requirements for the storage of hazardous wastes at three units; a drum-handling unit, a roll-off container unit, and liquid waste storage tanks, the treat of hazardous waste at two units; treatment tanks and surface impoundments, and the disposal of hazardous waste in a double-lined hazardous waste landfill with a capacity of 553,200 cubic yards and covering approximately 35 acres. The TP Permit is the only permit for a commercial hazardous waste disposal facility in New Mexico. The Permit specifies that it shall be effective for a term of ten years. The hazardous waste portion of the Triassic Park Waste Disposal Facility has not yet been constructed.

November 17, 2016 – Public Comment Period Second Extension – NMED issued a public notice extending the public comment and request for public hearing on the draft Permit. The public comment period began on June 15, 2016, and was extended initially to November 18, 2016. The public comment period was extended to 5:00 PM MST, January 20, 2016. October 22, 2016 – Public Meeting – NMED hosted a public meeting at the Holiday Inn located at 3620 North Main Street, Roswell, New Mexico. The presentation (English). La presentación en Español.


September 23, 2016 – Notice of Public Meeting – NMED issued a notice regarding the upcoming public informational meeting on the draft Permit. The public meeting occurred on October 22, 2016 at 1:00 pm at the Holiday Inn located at 3620 North Main Street, Roswell, New Mexico. August 12, 2016 – Public Comment Period Extended – NMED issued a public notice extending the public comment and request for public hearing on the draft Permit. June 15, 2016 – Draft Permit Public Comment Period – NMED issued a public notice for public comment and request for public hearing on the draft Permit. The public comment period began on June 15, 2016.

July 5, 2013 – The Permittee submitted a revised permit application to address deficiencies in the NMED February 5, 2013 Notice Disapproval Letter.


July 5, 2013 – NMED approved the request for an extension to respond to the NMED Disapproval Letter


July 2, 2013 – The Permittee requested an extension to respond to the NMED Disapproval Letter


February 5, 2013 – NMED issued a Disapproval Letter to the Permittee on the Part A and B Renewal Application.


May 17, 2012 – NMED determined the application to be administratively complete.


April 30, 2012 – The Permittee submitted a revised permit application to address deficiencies in the NMED Notice of Administrative Incompleteness letter.


March 14, 2012 – NMED issued a letter to the Permittee indicating that the permit application was determined to be administratively incomplete.


November 29, 2011 – NMED notified the public via a mail-out and publication in major local newspapers that the October 17, 2011 hazardous waste permit renewal application (see below) was submitted to the NMED and that it is available for public review. See the public notice by clicking here. The notice explains that no action or decision is proposed by NMED at this time regarding the permit renewal application.


October 17, 2011 – The Permittee submitted to the New Mexico Environment Department (NMED) a hazardous waste permit renewal application for the Triassic Park Waste Disposal Facility. The renewal application proposes a significantly scaled back facility, retaining the ability to dispose of hazardous waste in the landfill.
