Section  319(b)(1)  of  the  CWA  states,  “[t]he Governor of each State, for that State or in combination with adjacent States, shall- after notice and opportunity for public comment- submit to the [EPA] Administrator a management program for controlling pollution added from nonpoint sources to the navigable waters within the State and improving the quality of such waters, which such State proposes to implement in the first four fiscal  years beginning after the date of submission.” This page provides the current Nonpoint Source (NPS) Management Program Plan and information on the plan update:

The New Mexico Environment Department is seeking comments on a draft plan for managing nonpoint sources of pollution in surface waters in non-tribal portions of New Mexico. The Nonpoint Source Management Program plan is a requirement of Section 319 of the federal Clean Water Act. Comments will be accepted through July 22, 2024. The current plan (approved in 2019) and the draft plan are available below. Public comments can be emailed to WPSProgram.manager@env.nm.gov or submitted via the NMED Public Comment Portal.
