The proposed rule is a third-party petition by Triad National Security, LLC; and the United States Department of Energy’s National Nuclear Security Administration. The New Mexico Environment Department are not a petitioner in this matter but have participated in the development of the proposal by providing comment and feedback since the beginning of the project.

The Petitioners prepared a demonstration for the proposed Sandia Canyon UAA and accepted comments and feedback during their 30-day public comment period. In December of 2024, the petitioners asked the Water Quality Control Commission (WQCC) for a hearing to consider adopting their proposed UAA. The hearing was scheduled for May 13, 2025.
