Proposed Hazardous Waste Regulations


Regulations Adopted
The New Mexico Hazardous Waste Management Regulations, 20.4.1 NMAC became effective on December 1, 2018.

October 19, 2018 – The Environmental Improvement Board has adopted the proposed New Mexico Hazardous Waste Management Regulations, 20.4.1 NMAC.  The Regulations will become effective on December 1, 2018.

Proposed Regulations
The New Mexico Environment Department is proposing to amend the New Mexico Hazardous Waste Management Regulations, 20.4.1 NMAC, by incorporating the final rules established by the U.S. Environmental Protection Agency (EPA) (see table below). 

The amendments are for the purpose of updating the Hazardous Waste Management Regulations, 20.4.1 NMAC, to bring them into conformity with federal regulations. The federal regulations must be adopted before the Environment Improvement Board and then the Environment Department can obtain required authorizations from the EPA for its Hazardous Waste Management Program. The current regulations adopt federal regulations through June 30, 2008. With the proposed amendments, the federal regulations would be adopted for the rules listed on the table below. Following approval of these amendments, the Department intends to submit the revisions to the Environmental Protection Agency to obtain an updated federal authorization of its Hazardous Waste Program.

The New Mexico Environmental Improvement Board (“Board” or “EIB”) will hold a public hearing beginning at 9:30 a.m. on August 24, 2018, and continuing thereafter as necessary at the New Mexico State Capitol Building, Room 307, 490 Old Santa Fe Trail, Santa Fe, New Mexico. The hearing location may change prior to the hearing date, and those interested in attending should check the EIB website: prior to the hearing.

May 25, 2018 – The Department petitioned the Environmental Improvement Board (EIB) at their May 25, 2018 meeting to schedule a public hearing for the proposed adoption of the Hazardous Waste Management Regulations, 20.4.1 NMAC.
