Proposed Hazardous Waste Regulations

Proposed Hazardous Waste Fee Regulations
The New Mexico Environment Department is proposing to revise the Hazardous Waste Permit and Corrective Action Fees (Fee Regulations), 20.4.2 NMAC.  An initial introduction to the proposed Fee Regulations was provided at a February 7, 2019 teleconference.

A meeting is being planned in the near future for further discussion the proposed Fee Regulations with the regulated community.

New Generator Rule
The Environmental Improvement Board (EIB), the promulgating authority for hazardous waste regulations, adopted the recent federal generator rules which have been incorporated by reference into the New Mexico Hazardous Waste Management Regulations, 20.4.1 NMAC.  The Hazardous Waste Bureau is providing a New Rule Crosswalk to indicate the previous regulatory requirements and the newly adopted regulations.

Regulations Adopted
The New Mexico Hazardous Waste Management Regulations, 20.4.1 NMAC became effective on December 1, 2018.

October 19, 2018 – The Environmental Improvement Board has adopted the proposed New Mexico Hazardous Waste Management Regulations, 20.4.1 NMAC.  The Regulations will become effective on December 1, 2018.
